Welcome to Xavioo! These Terms of Service ("Terms") govern your use of the Xavioo website, application, and related services (collectively, the "Platform"). The Platform is owned and operated by Imperium Technologies LLC, a limited liability company registered in Wyoming, USA, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801 ("Company," "we," "us," or "our").

By accessing, registering for, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1. ACCEPTANCE OF TERMS

By creating an account or accessing the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy, Payment Policy, and Community Guidelines, which are incorporated herein by reference.

2. STRICT 18+ AGE REQUIREMENT AND ELIGIBILITY

2.1. Absolute Age Restriction: The Platform contains content, including live video streaming and interactive features, that is strictly intended for adults. YOU MUST BE AT LEAST EIGHTEEN (18) YEARS OF AGE (or the age of legal majority in your jurisdiction, whichever is higher) to access or use the Platform.

2.2. Zero Tolerance: Access to the Platform by anyone under the age of 18 is strictly prohibited and is in direct violation of these Terms. If we discover or have reasonable suspicion that an account belongs to or is being used by a minor, the account will be immediately and permanently terminated without notice, and any associated funds or credits will be forfeited. We reserve the right to report such incidents to relevant authorities.

3. ACCOUNT REGISTRATION AND SECURITY

3.1. Account Creation: To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration.

3.2. Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.

3.3. Identity Verification: We reserve the right to require age and identity verification at any time. Failure to provide valid government-issued identification upon request will result in immediate account suspension.

4. IMMEDIATE TERMINATION AND SUSPENSION RIGHTS

4.1. Discretionary Termination: The Company reserves the absolute right to suspend, disable, or terminate your account, and restrict your access to the Platform at any time, immediately, and without prior notice or liability, for any reason whatsoever.

4.2. Grounds for Termination: Reasons for immediate termination include, but are not limited to:

  • Violation of these Terms or our Community Guidelines.
  • Suspicion of fraudulent activities, chargebacks, or unauthorized payment methods.
  • Engaging in illegal, abusive, harassing, or threatening behavior.
  • Compromising the technical security or integrity of the Platform.

4.3. Effect of Termination: Upon termination, your right to use the Platform ceases immediately. You will lose access to all data, content, and purchased digital credits associated with your account. No refunds will be issued for banned accounts.

5. USER CONDUCT AND CONTENT

5.1. Prohibited Activities: You agree NOT to use the Platform to:

  • Violate any applicable local, national, or international laws, including those of Wyoming, USA.
  • Distribute, broadcast, or promote child sexual abuse material (CSAM), non-consensual intimate imagery, terrorism, or extreme violence.
  • Engaging in fraud, phishing, or spamming.
  • Attempt to reverse engineer, hack, or disrupt the Platform's services.

5.2. User Content: You retain ownership of the content you broadcast or upload. However, by using the Platform, you grant the Company a worldwide, royalty-free, non-exclusive license to host, store, display, and transmit your content solely for the purpose of operating the Platform.

6. PURCHASES AND VIRTUAL CREDITS

The Platform utilizes a virtual currency system ("Credits"). All purchases of Credits are final, non-refundable, and non-transferable, except as strictly required by law. Please refer to our Payment and Refund Policy for detailed terms regarding transactions and chargeback protections.

7. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

7.1. "AS IS" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the continuous availability, security, or error-free operation of the Platform.

7.2. Limitation of Liability: To the maximum extent permitted by the laws of Wyoming, USA, Imperium Technologies LLC, its owners, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1. Governing Law: These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles.

8.2. Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts located in Sheridan, Wyoming, USA, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date at the top of this document or via a Platform notification. Continued use of the Platform after such changes constitutes acceptance of the new Terms.
